I can’t really answer that question without knowing the facts of the case. It’s a decision that you and your attorney should make after a thorough discussion of the evidence. Lots of attorneys look to negotiate a plea agreement immediately without really a robust examination of the evidence or the discovery in the case. I am a trial attorney so my first instinct is to review all the evidence. Once we have all that evidence I go over it with my client and make sure that they understand all that. Then, from an examination of the evidence, my client and I decide what the best strategy is to approach the case. In other words, do we think we have a chance to fight the case and take it to trial or do we have a motion to suppress evidence that is available to us or is the evidence overwhelming and is it the best decision to try and do some damage control and negotiate the case. But really that would all depend on the facts.
